Terms of the Account and the Album Fotillo Cloud Service

*This document is an English translation of the Polish Terms of the Account and the Album Fotillo Cloud Service, provided for information purposes only. Solely the Polish version is binding.*

§1 General provisions

1. These Terms set out the rules for maintaining an Account and providing the Album service within Fotillo Cloud.

2. The service provider is Tomasz Mróz and Justyna Mróz, doing business as ViewPro s.c. T. Mróz, J. Mróz, ul. Skoroszewska 2B/34, 02-495 Warszawa, Poland, NIP 5223019335, REGON 147452308, e-mail: contact@fotillo.com.

3. In matters not regulated herein, the Fotillo Cloud Terms of Service (the "Cloud Terms") apply accordingly, in particular §6 (rules for End Users), §7 (Prohibited Content), §8 (reporting content and moderation), §11 (point of contact), §12 (liability) and §15 (final provisions). Capitalised terms not defined in these Terms have the meaning given to them in the Cloud Terms.

4. The Album service is hosting in nature: the Provider stores Content transferred at the request of the Holder and of persons using the functions made available by the Holder. The Provider does not carry out prior, general control of the Content transferred.

5. Information on the processing of personal data is set out in the Privacy Policy.

§2 Definitions

1. Account – the Holder's individual account within Fotillo Cloud, comprising the Album.

2. Album – the space of the Account in which Content from an event is stored: transferred from Devices or sent by guests.

3. Holder – the person who created the Account and uses the Album for personal or household purposes (e.g. a married couple collecting mementoes from their reception).

4. Event Code – a code generated by the Holder enabling Devices to be linked with the Album for the duration of an event.

5. Session Link – a single-use link (QR code) generated for an individual session at a Device, enabling only the transfer of Content.

6. Guest Link – a multi-use link (QR code) generated by the Holder, enabling guests to send photographs and videos directly to the Album, bypassing the Device.

7. Gallery – a function for publishing Content selected by the Holder under a single link, for viewing purposes.

8. Trial Period – a free period of 30 days from the creation of the Account, with the Capacity indicated on the Service's pages.

9. Capacity – the storage space of the Account intended for Content.

10. Validity – the day up to which the Account operates with full functionality.

11. Account Value – the product of the Capacity and the number of days of Validity, expressed in capacity-days; it forms the basis for settling Packages (§10).

12. Package – a paid increase in the Account Value, corresponding to a specified Capacity maintained for 182 days; a month means 30 days.

13. Top-up Code – a single-use code corresponding to the selected Package, sold in the fotillo.com online shop and redeemed in the Account.

14. Grace Period – a period of 1 month after the expiry of the Account's Validity, during which the Album operates in a limited mode.

§3 Creating an Account and the purpose of the Album

1. Only an adult may create an Account. Creating an Account requires: an e-mail address (verified by an activation link), a password, a declaration of being of age, and acceptance of these Terms.

2. The contract for maintaining the Account is concluded upon confirmation of registration and is performed immediately. By consenting to the immediate commencement of performance, a consumer acknowledges that, once the service has been fully performed for a given period, they lose the right of withdrawal; irrespective of this, they may delete the Account at any time (§12).

3. The Provider records the fact, time and version of the accepted documents and the IP address. Upon registration, the Provider also makes the Privacy Policy available; it is informational in nature and does not require acceptance.

4. The Album is intended solely for the Holder's personal or household purposes. Using the Album in connection with business or professional activity requires an operator account maintained under the Cloud Terms together with the DPA.

§4 Event Code and pairing of Devices

1. The Holder generates an Event Code in the Account and provides it to the Device operator's staff. The Code is valid for 7 days from generation; the Holder may refresh it, which invalidates the previous code and creates a new one.

2. Pairing is active for 12 hours from the entry of the Code into the Device. The pairing time is measured solely by the Service server. The Holder may extend an active window by 6 hours, up to a total of 24 hours for a given Device, and may end the pairing at any time.

3. A maximum of 3 Devices may operate on a single Event Code. Each Device has its own pairing window, counted from its activation.

4. Within 24 hours of the window expiring, the same Device may reactivate pairing with the same Code (e.g. where the event ran longer). Activating a different Device after the window has expired requires a new Code.

5. During active pairing, the Device transfers Content directly to the Album and may read Content from the Album solely for the purpose of printing it at the event.

6. An Event Code cannot be generated if less than 48 hours remain until the end of the Account's Validity. The expiry of Validity does not interrupt an active pairing; Content from an ongoing event is accepted until the end of the window.

7. Once the Account is deleted, expires or enters the Grace Period, the Album does not accept new Content, and Devices receive information that the Album is closed.

8. Pairing with a Device is an optional function. An Album may also be maintained without a Device, solely from Content transferred by guests via the Guest Link (§6).

§5 Album content

1. After each printed session, the Device transfers to the Album the printed photograph (collage) and the original photographs from the session in full resolution.

2. Content in the Album consists of separate copies, independent of the sharing carried out under the operator's account (a link or QR code for a guest at the Device). Deleting Content shared with a guest does not delete its copy from the Album, and deleting Content from the Album does not delete the Content shared with the guest or the local copy on the Device.

3. Sending photographs from a phone for printing in the Device remains a function of the operator's account and is not covered by these Terms.

§6 Transfer of Content by guests

1. Session Links are single-use, allow only the transfer of Content from a given session and are valid for 24 hours from creation, regardless of the expiry of the pairing. Each subsequent session means a new Link; it is not possible to regain access to earlier Content.

2. The Guest Link, where the function has been made available, is valid for 7 days from generation and enables photographs and videos to be sent to the Album. The technical limits published with the upload function apply, in particular a maximum file size of 500 MB and mp4/mov formats for videos; the Provider may change the limits, giving notice on the Service's pages.

3. The transfer of Content is voluntary and is made for the benefit of the Holder, as the handing over of a memento from the event. Before sending, the person transferring accepts the rules of §6 and §7 of the Cloud Terms (by ticking a checkbox); the Provider records the acceptance together with the IP address in accordance with §6(1) of the Cloud Terms.

4. The Holder may invalidate the Guest Link and stop accepting Content at any time.

5. A person who has transferred Content may request its deletion under §8 and §9 of the Cloud Terms applied accordingly (a report to contact@fotillo.com or via the reporting function, where available). This does not limit the Holder's rights under §9.

§7 Prohibited Content and moderation

1. The prohibitions set out in §7 of the Cloud Terms apply to all Content transferred to the Album. It is prohibited in particular to transfer Content that: depicts the sexual abuse of minors, is pornographic, incites hatred or violence, infringes the dignity, privacy, image or other rights of third parties, or is unlawful in any other way.

2. The Provider has the right to delete or disable access to Content infringing these Terms, to suspend the Guest Link, the Gallery or an Account used for infringements, and, in justified cases, to preserve the Content as evidence.

3. In the case of Content depicting the sexual abuse of minors, the Provider immediately disables access to it, secures it as evidence and notifies the competent authorities.

4. The Provider may use tools for automated, preliminary filtering of Content; the decision to delete Content is taken by a human.

5. Reports of Content are accepted under §8 of the Cloud Terms. The provisions of this paragraph do not establish any obligation on the Provider to monitor Content in advance.

§8 Gallery

1. The Gallery, where the function has been made available, contains solely Content selected and published by the Holder. A link to the Gallery permits viewing only.

2. Two functions are available under each item of Content in the Gallery: "Request removal" (a request with a name and reason, forwarded to the Holder) and "Report infringement" (a report to the Provider under §8 of the Cloud Terms).

3. The Holder decides on the scope of publication in the Gallery and is responsible for its lawfulness, in particular as regards the image rights of persons visible in the Content. By sharing a link to the Gallery, the Holder is responsible for who they give it to.

4. The Provider may suspend the Gallery in the event of infringements, pending clarification.

§9 Managing the Album

1. Content in the Album remains at the Holder's disposal: they may view it, download it, delete items individually and delete all of it together with the Account.

2. The Holder may export all Content at any time (export to a ZIP file).

3. The storage period of Content in the Album follows from the status of the Account (§10) and takes precedence over the storage period under §10 of the Cloud Terms, in accordance with §3(6) of the Cloud Terms.

4. The moderation powers set out in §7 of these Terms apply to Content in the Album.

§10 Trial Period, Packages and Grace Period

1. During the Trial Period (30 days from the creation of the Account) the Album service is free of charge, with the Capacity indicated on the Service's pages.

2. Continued use of full functionality requires an increase in the Account Value by redeeming a Top-up Code (§11). The Account does not renew automatically.

3. Settlement is based on the Account Value, understood as the product of the Capacity and the number of days of Validity. A Package corresponds to maintaining its Capacity for 182 days. The Account's Validity results from dividing the Account Value by the selected Capacity, which is why a greater Capacity means a shorter Validity for the same Value, and a smaller Capacity — a longer one.

4. The Holder may change the Account's Capacity at any time, within the limits available on the Service's pages. A change of Capacity does not change the Account Value and results in a proportionate recalculation of the Validity. Reducing the Capacity below the size occupied by Content is not possible until space is freed.

5. Once the Capacity is used up, the Album does not accept new Content until space is freed or the Capacity is increased. Content transferred earlier remains available.

6. Before the Validity expires, the Provider reminds the Holder by e-mail of the possibility of topping up the Account: 7, 3 and 1 day before that date.

7. After the Validity expires, a Grace Period of 1 month begins: the Album does not accept new Content, while the Holder retains access to viewing, downloading and export. The Provider notifies the Holder by e-mail of the start of the Grace Period and no later than 7 days before the Account is deleted.

8. Once the Grace Period has expired without effect, the Account and the Content are permanently deleted, and the deletion operation is logged. Registers of document acceptance and technical logs are stored for the periods indicated in the Privacy Policy.

9. Redeeming a Top-up Code during the Grace Period restores the full functionality of the Account.

10. The Account is not subject to closure on grounds of inactivity. The availability of Content is determined solely by the Account's Validity and the Grace Period.

§11 Purchase of Packages in the shop and redemption of the Top-up Code

1. Packages are sold in the fotillo.com online shop. The purchase, prices, payments, invoices, information obligations and complaints relating to the purchase are governed by the fotillo.com Shop Regulations. The Album service does not handle payments and does not process payment data.

2. Information on the current Packages and prices is available on the Service's pages and in the shop. Prices are total prices and include taxes.

3. After paying for the order, the buyer receives by e-mail a single-use Top-up Code corresponding to the selected Package.

4. The Top-up Code is single-use, linked to the Account identifier provided at purchase and may be redeemed solely on that Account. Album Package codes do not work in other Fotillo services, and codes of other services do not work in the Album.

5. A Package increases the Account Value by its Capacity maintained for 182 days. The Holder uses that Value as they choose: as a greater Capacity or a longer Validity of the Account; on an Account with a greater Capacity the same Package adds correspondingly fewer days of Validity.

6. The Top-up Code is redeemed in the Account and increases its Value by the Value of the Package. On redemption, the Holder chooses whether to increase the Account's Capacity or to extend its Validity; before making the choice, they see both resulting Validity dates. Redemption is single-use and irreversible, of which the Holder is informed before confirming it.

7. The Top-up Code has no expiry date; it may be redeemed at any time, including during the Grace Period.

8. A Code redeemed during the Account's Validity increases its Value, counting from the day the current Validity expires. A Code redeemed during the Grace Period counts from the day of redemption.

9. Using the Account and the Album requires: a device with internet access, an up-to-date web browser and an active e-mail address. Playing videos requires support for the formats indicated with the upload function.

10. The Provider is liable to consumers for the conformity of the digital service with the contract, on the terms set out in the Polish Consumer Rights Act. Complaints about the operation of the Service are submitted under §12(4), and complaints about the purchase of a Code under the Shop Regulations.

11. Information on out-of-court means of handling complaints and pursuing claims (the municipal or district consumer ombudsman, the Trade Inspection Authority, the konsument.gov.pl platform and, for consumers from other EU countries, the ECC-Net network) is available on the websites of those institutions.

§12 Deletion of the Account, withdrawal and complaints

1. The Holder may at any time delete the Account together with all Content using the function in the Account (with password confirmation) or by request to contact@fotillo.com. Deletion is permanent and irreversible and deactivates all links and QR codes leading to the Content, subject to backups being overwritten in a cycle of up to 7 days (§10(4) of the Cloud Terms).

2. The Top-up Code is digital content supplied by electronic means. Under the fotillo.com Shop Regulations, placing an order for a Code requires the consumer's express, prior consent to the supply of the digital content before the withdrawal period expires and their acknowledgement that, upon delivery of the Code, the consumer loses the right of withdrawal. A delivered Top-up Code is therefore not refundable. This does not exclude the consumer's rights arising from the non-conformity of the digital content or service with the contract (§11(10) and §12(4)).

3. Deletion of the Account by the Holder before the Validity expires, as well as a change of Capacity that shortens the Validity, do not give rise to a refund of the fee for the unused period. The Account Value is not exchangeable for money. This does not affect refunds due under the law, in particular for non-conformity of the service with the contract and for discontinuation of the service by the Provider (§13).

4. Complaints are accepted at contact@fotillo.com and handled within 14 days.

§13 Discontinuation of the Album service

If the Provider decides to discontinue the Album service in full, it will notify Holders by e-mail at least 12 months in advance, allowing them during that time to export all Content. Unused Account Value is subject to a proportionate refund.

§14 Changes to the Terms and final provisions

1. §14 of the Cloud Terms applies to changes to these Terms, save that Holders are notified of changes by e-mail.

2. These Terms apply to Accounts created from the date of their entry into force. Accounts created earlier are governed by the version of the Terms accepted by the Holder, including the previous Grace Period and the previous capacity, until the first Top-up Code is redeemed on that Account after the entry into force of these Terms; from that moment the Holder accepts these Terms and they apply to their Account.

3. The governing law is Polish law. Solely the Polish-language version of the Terms is binding.
